This Just In: Girl suspended for nose ring

RALEIGH, N.C. – A soft-spoken 14-year-old's nose piercing has landed her a suspension from school and forced her into the middle of a fight over her First Amendment right to exercise her religion. Her religion? Yes, Ariana Iacono says she just wants to be a normal teenager at Clayton High School, about 15 miles southeast of Raleigh. She has been suspended since last week because her nose ring violates the Johnston County school system's dress code, which doesn't mention freedom of religion, and just doesn't allow nose rings.
"I think it's kind of stupid for them to kick me out of school for a nose piercing," she said. "It's in the First Amendment for me to have freedom of religion." School leaders must have choked at that statement. Religion? Nose rings? Just when we thought it was safe to wear a hijab to school, this happens!
Iacono and her mother, Nikki, belong to the Church of Body Modification, (that explains it, Amen brother.) a small group unfamiliar to rural North Carolina, (and possibly the rest of the world, until now, that is.) but one with a clergy, a statement of beliefs and a formal process for accepting new members.
The Iaconos say the school system is ignoring its own dress code policy, which allows exemptions on religious grounds. The effect, Nikki Iacono, 32, says, is that Johnston County school officials are setting themselves up as judges of what constitutes a "real" religion. Anyone with a website and a tax exemption credit can claim they're a religion these days. But does this one believe in a God of any sort. And does He have a nose ring?
Richard Ivey, (pictured at right) the Iaconos' Raleigh-based minister in the church, believes it's a case of officials dismissing something unfamiliar.
"They're basically saying, because they don't agree and because they choose not to respect our beliefs, that it can't be a sincerely held religious belief," he said.
Ivey describes the church as a non-theistic faith that draws people who see tattoos, piercings and other physical alterations as ways of experiencing the divine. Non theistic faith. Hmmm, does that mean they don't believe in ANYTHING, except perhaps, mutilating their bodies?
"We don't worship the god of body modification or anything like that," he said. "Our spirituality comes from what we choose to do ourselves. Through body modification, we can change how we feel about ourselves and how we feel about the world."
The church claims roughly 3,500 members nationwide, having started about two years ago, after adopting the name of a similar group that had been dormant for several years. I wonder why the other "church" had to go "dormant:". Did the last pastor cut off his own head?
The Johnston County schools dress code policy prohibits several types of facial jewelry but does allow officials to make accommodations for sincerely held religious beliefs.
"One of the remarkable things about religious freedom is that people have all kinds of beliefs that look to others as bizarre but make internal sense to them," Gordon said. "We really can only claim to be a country that respects religious liberty if we respect the variety of beliefs that exist in the country — both new and old."
The Iaconos have contacted the North Carolina ACLU chapter for help, and legal director Katy Parker says the school is on shaky ground.
"We do think she has a right to wear her nose ring," Parker said. At least mom is behind this. What if Araiana wanted to wear her nose ring and mother were against it? Does PERSONAL freedom of religion then come into play? To what lengths do we go to identify "religion" in America anyway?
A similar situation to the Iaconos' went to the courts in 2002, when a woman was fired from her job at a Costco store over her eyebrow ring. The woman was also a member of the Church of Body Modification, but the courts eventually ruled that her religious beliefs did not require her to always wear her jewelry. So Miss Costco wasn't allowed to wear HER eyebrow ring on the job, hmmm? Is the workplace any different from the school system? The courts sided with the workplace in that situation.
The ACLU, like the Iaconos and their minister, hope their issue can be resolved without going to court. In the meantime, Nikki and Ariana pick up schoolwork for her to do at home while her peers sit in class.
"I hope they're going to stop suspending me and clear some of these absences from my record," Ariana said. "I want to get into a good college." The College of Tattooing and Piercing, I'd wager.
In no way do I mean to criticize "body modification." I just got a smile out of the story when it was stated it's a religion now. Back in the Pentecostal faith, we were taught that the body is a temple, and "modification" was frowned upon. Far be it for me to judge. Tattoos and piercings are quite common nowadays. Perhaps the school systems SHOULD allow nose rings. There are places that rings can be put where nobody would see them normally (except perhaps in gym showers.) That is, if mom and dad are okay with it. To the left is "The God of Body Modification" by the way. He does exist, and I don't think he "evolved" scientifically either. And maybe THIS GUY is the body modification devil. (I'm just joking around with this,

A plain ring/chain would be one thing, but the one with all the "bling" is just screaming for attention, which seems to me to be the point of the whole thing.

This is funny. But honestly, there's no good reason to tell her she CAN'T wear the jewelry, and if she wants to claim its a religious belief, I don't see how it somehow infringes on other's rights to let her practice that how she sees fit. It's a dangerous and sticky line we walk when we start saying that some expressions of internalized belief are bad and others are good.

@quodmenutriut - @thegirlwiththecamera - It might be noted that back in 1970 I was part of a group of students who fought to change the dress code in our high school. We did it too. I chaired a "student faculty" meeting in the auditorium which got more attendance than any other "assembly" that year. I wanted to wear my hair (yes, I had hair, long beautiful hair, gleaming, flaxen, waxen) long. Alas, we graduated but after that year, kids were allowed long hair and the gals didn't have to kneel down any more while admiinistrators "measured" their dresses to make sure they werent too short. (No nose rings that I can recall.)

If it was a small piercing, I don't see the issue the school is raising. However, since her religion does not dictate she is required to always have the piercing in, she has no actual argument to put forth.
Granted I think it is bull for them to state this is religious, I still think she should be let alone. However, this is coming from a girl who has 4 tats and 8 piercings. I just don't see the big deal. A piercing is not hurting anyone.

Not since I'm not THAT old, I have nothing against tats, piercings and the like. But multiple facial piercings and these gigantic objects, and pencil sized holes in hears * my kids better hide their faces from me if I do something like that as I will pitch a raging yelling session on their asses.
You're right. Almost anything can claim to be a religion if they get the right tax exemption sheet. I would know because I used to work at a Electronics store and had to deal with them daily. It's a pain really. Though honestly, this is no religion. It's more of refusing to follow the rules at all! And picking a battle that doesn't need to be fought. I had one friend that went through all of high school with a nose ring and they didn't bother her...though they probably didn't care too much because she wasn't white but rather middle eastern. So they didn't cause any fuss against her.
Though I don't believe in this..as the only piercings I have are in both my earlobes. Nothing more. I don't want anything more. But I think, she will just have to stop being a rebel and follow the rules like everyone else. Religious or not, as she claims.
@maniacsicko - I was thinking the very same thing! If anyone can start a religion for anything, and then no public institution can say anything about it.. well I don't want to live in that society. Yes, we have freedom of religion, expression, and speech.. but there have to be limits too. I don't want people walking around naked down the public square, or sitting naked in my classroom.
I think it's stupid that the school system is arguing with her about her very small nose ring. It's not disruptive. Although, it's equally stupid that their counter-argument is that this is a religious thing. Don't bring religion into it. There are plenty of legitimate arguments you can make in favor of the nose ring without bringing religion into it.
And of course the ACLU is supporting this girl - insert eye roll here. Ridiculous.

In a way, I find this article rather ironic.
All honesty though, sometimes the whole "my body is a temple" argument kind of gets on my nerves. Mainly just because a lot of people refuse being an organ donor due to that argument. I argue that by believing this that by sharing your body, you are only allowing others into your temple. You are sharing the glory that your God has given you.
I'm a huge Organ Donation advocate though myself.
I pierced my ears simply because I didn't want to wear large earrings...for me the smaller the better...Just a little glitter when the hair blows. I agree that if the girl had any of the larger jewelry such as the top picture. I would not let her wear it in school because of the liability if someone jerked it...but what the girl is wearing is not dangerous. My husband is not allowed to wear his wedding ring at work..he works with slitting machines and if his ring caught at the speed those scissors spin he could easily say goodbye to a hand. I guess schools have to draw the line somewhere and it would be difficult to say no nose piercings if they were larger than a pencil, or circular like a ring. I personally would have just turned the other way until one of the more serious (large) jewelry started as a fad.
I had my nose pierced all through middle school and high school. Just I kept clean fishing line in it during school, to hide it. Now I have my septum pierced (like a bull, yes) and it's very must less socially acceptable then a nose stud, that's for sure. Any ways, I don't see a problem with have it, religion smaligion.
At my old high school there was a strict hair rule for guys, it couldn't in their eyes nor touching their collar, but one boy claimed it was his heritage to have long hair since he was native american and they let him slide. So yeah, there are some loop holes to the rules. Just gotta find them, ones that make sense, preferably though lol
@baldmike2004 - Whoops, my bad. I HATE when people don't read closely enough. For some reason that usually happens to me, too, when I include a picture I have obtained from another source and CLEARLY labeled. Thank you for the correction. I can only plead being in a rush to leave for work, and yet wishing to respond.
That said, I think this is a frivolous thing, really. Sure, it's "no big deal", but I have seen this before, where people get all bent out of shape pursuing something so silly that they are MAKING it a big deal.
I may not approve, but I see that kind of thing everywhere, even in my little, conservative town, and while I wouldn't do/wear any of it myself, and would prefer that my child not, either, it is a trend right now.
But a religion? Now that's a good one.
Makes me think of what my mother said when i had my ears pierced: "Just what you need, another hole in your head!"

It'd be interesting for precedent if the ACLU manages a win on this one. School Districts are getting away with a number of things in a post-Columbine world that are growing more and more ludicrous. There was a 7 year old girl and her 9 year old brother suspended from a Chicago elementary earlier in the year. Their violations? Her shirt had a flower on it, and his was plaid. That school only allowed plain, mono-coloured shirts. One I remember having some issue with in my high school was that boys weren't allowed to have hair longer than their shoulders... but girls were. Sexist much? Wouldn't be an issue for you though, right Mike? =P

Interesting little piece, I agree that the courts will recognize just about anything as a "sincerely held belief" as a religion. The difficult part comes in for people claiming odd things though because there has to be an established pattern to their practice and they CANNOT be caught doing something inconsistent or they lose the basis for "sincerely held".

I've always wondered where we as a society are allowed to draw the line between respected religion and sheer strangeness. When does tolerance give way to special privileges? I went through this line of questioning when a specific tribe of Native Americans was given the right to use peyote as part of their religious rights. Now I want to create a church that believes in smoking weed... but not really anything else. How far would I have to go to make this credible?
I've heard so many stories about people who've gotten supsended because of their hair, a small tattoo, or like this girl, a piercing in the facial region. I hate that those people were discriminated like that! I used to chang my hair and have multiple colors in my hair all the time. (I like to believe that I started the coloring of the air thing at my school cause after my friend and I dyed our hair blue and what not others started.) My school was stupid and our principle once said, "We will not accept non-comformaty". It made me laugh. But... I like the idea of this religion. I love body mods. xD And it's risiculous that this girl got suspended because of her nose ring! I'd FLIP if my school EVER suspended me for my hair or my friend for her hair and piercings. And so would my parents!!

This is a very interesting article, and I liked your commentary. I think that if I were the school administration, I would just let her wear the nose ring. The whole point of dress codes is to prevent distraction from the learning environment, and I would wager that this lawsuit is causing a lot more throuble with that than wearing a nose ring. On the other hand, if every part of the dress code has exceptions that can be pushed, there's really no point in having a dress code. If she goes back to school and is allowed to wear her nose ring, I can guarantee that some of the other students will say, "If she can wear a nose ring, why can't I wear a nose ring?" The administration has to say, "Because you're a Christian (or whatever that student is)." That puts them in a catch 22. No matter what they do, it's religious descrimination.
Also, if any part of the dress code has exception for religious beliefs, all of it does. What if someone is in a nudist religion, as @maniacsicko said? Or what if they believed in wearing ceremonial weapons? At some point, common sense has to catch up to this situation. I say they have to either have no dress code at all or have a strictly enforced dress code. Everything else is unfair.

I have no pierced on my ears or any part of my body and I have nothing against anyone who does. But this issue discussed above have disturbed me a lot although I have also nothing against this group. I am a former teacher, upper elementary and high school. I always thought that dress codes were basically too arbitrary, too strict and served very little purpose with respect to education. It seemed that they were more trouble to enforce than they were worth as well. There is a H.S. in this area that does not have dress codes, and they are not having any problems, according to the pricipal. The students there seem to appreciate the freedom, and they don't wear obviously distracting items or overly revealing clothing. That seems to me to be a common sense way to deal with it. If there is a case of inappropriate dress or item, it's dealt with on a case basis and with counseling, not arbitrarily.
So, religion or no religion, if a girl's nose or eye brow is pierced with a small piece of jewelry, where's the harm? Are pierced ears also banned? I feel the same way about hair length for boys as long as the hair is clean. I read of a case in which a girl was suspended for having a key chain in school! Ridiculous! I agree with Fireflywishes.
However, this incident brings up the conflict between freedom of religion vs. rules and laws. It's another one of these situations which I like to describe with the British term, "Sticky wicket." There are cases where religious freedom does not trump certain laws. Don't have time to go into all that now, though. I've already commented enough.
